The minutes of 29th September 2025 were agreed as a true record and signed by the Chair.

Declarations of Interest

To receive declarations by Councillors of interests in respect of items on this Agenda. 

Councillors are reminded that, in accordance with the Localism Act 2011, they are required to declare any disclosable pecuniary interests which have not already been declared in the Council’s Register of Interests. (It is a criminal offence not to declare a disclosable pecuniary interest either in the Register or at the meeting). 

Whilst not a legal requirement, in accordance with Council Procedure Rule 9 and in the interests of clarity and transparency, Councillors should declare any disclosable pecuniary interests which they have already declared in the Register, at this point in the meeting. 

In accordance with Part B Section 2 of the Code Of Conduct, Councillors are required to declare the existence and nature of any other interests as defined in paragraphs 8(1) or 9(2) of the Code of Conduct. 

 

Minutes:

Councillors Martin Bottoms and Sue Tyldesley each declared an interest in agenda item A6 25/00615/FUL Car Park Nelson Street Lancaster. The reason being that they had both been members of the Cabinet of Lancaster City Council where the application had been previously discussed. Consequently, both Councillors would recuse themselves from the meeting for the duration of consideration of this item.

 

There were no other declarations of interest.

Under the scheme of public participation, Jeremy Boyd (Hollins Strategic Land LLP) spoke against the application. Paul Nellist (Asteer Planning) spoke in favour.

 

It was proposed by Councillor Sue Tyldesley and seconded by Councillor Dave Brookes:

 

“That the application be approved subject to the conditions in the Committee Report.”

 

Upon being put to the vote, 12 Councillors voted in favour of the proposal with none against and no abstentions, whereupon the Chair declared the proposal to have been carried.

 

Resolved:

 

That the application be approved subject to the following conditions:

 

the satisfactory completion of a Legal Agreement within 3 months of the date of this Committee meeting, to cater for the provisions below. In the event that a satisfactory Section 106 Agreement is not concluded within the timescale above, or other agreed extension of time, to delegate authority to the Chief Officer – Planning and Climate Change to refuse planning permission on the grounds that the obligations which make the development acceptable have not been legally secured;

A site visit was held in respect of this application on Monday 21st July 2025 by Cllrs Louise Belcher, Martin Bottoms, Dave Brookes, Alan Greenwell, John Livermore, Paul Newton, Caroline Potter, Robert Redfern, Sandra Thornberry, Sue Tyldesley and Paul Tynan. In attendance were Planning Applications Manager Jennifer Rehman and Principal Planning Officers Eleanor Fawcett. 

 

Under the scheme of public participation, Deborah Smith (Smith & Love) spoke in favour of the application, and Tom Fyson (Lancaster BID) spoke against.
