Members received the report of the Licensing Manager to enable consideration of the proposed changes to the Statement of Licensing Policy following the consultation process. 

 

It was reported that the Licensing Authority is bound by the Licensing Act 2003 and any regulations made under it, and is required to update its Licensing Policy every three years and to consult with stakeholders before publishing and implementing the updated Policy.   It was noted that the current Policy had come into force in January 2008. 

 

A summary of the proposed changes had been prepared by the Licensing Manager and published for consultation with stakeholders and interested parties.  Responses had been requested by 2nd November 2010.   Three responses had been received to the consultation and these were attached as Appendix 1 to the report.  It was noted that only one response was relevant. 

 

A summary of the proposed changes, taking into account the relevant representation received from Lancashire District Alcohol Harm Reduction Partnership, was attached as Appendix 2 to the report.  A copy of the proposed revised Statement of Licensing Policy was also appended to the report.

 

Members considered the appendices and revised Statement of Licensing Policy in detail.

 

It was proposed by Councillor Harrison and seconded by Councillor Kirkman:

 

“That the revised Statement of Licensing Policy be referred to Council on 15th December 2010 for approval and implementation in January 2011 in accordance with the statutory timeframes, subject to the amendments requested by Committee.”

 

Upon being put to the vote, Members voted unanimously in favour of the proposition, whereupon the Chairman declared the proposal to be carried.

 

Resolved:

 

That the revised Statement of Licensing Policy be referred to Council on 15th December 2010 for approval and implementation in January 2011 in accordance with the statutory timeframes, subject to the following amendments requested by Committee:

 

15.0 The Promotion of Public Safety

 

‘Licence holders should ensure that any spillages are cleaned up promptly to prevent slip hazards.’

 

20.4 Cumulative Impact

 

‘Please note that the Home Office has recently undergone a comprehensive consultation exercise on Rebalancing the Licensing Act.  One of the considerations of that consultation was the removal of evidential requirements for cumulative impact policies.  If any changes to the legislation or recommendations are made as a result of this consultation, our policy will be amended accordingly.’
