The Minutes of the meeting held on 6th October, 2005 were signed by the Chairman as a correct record.

Minutes:

Members were advised that the appellant, Mr Riley, was not in attendance.

 

The Committee agreed to adjourn the meeting to allow Officers to ascertain if Mr Riley had arrived.

 

The meeting was adjourned at 2.10 p.m.

 

The meeting was reconvened at 2.20 p.m.

 

Members were advised that Mr Riley was still not in attendance and it had not been possible to contact him. It was agreed that the meeting would continue in his absence.

 

The Committee considered an appeal against the awarding of four penalty points issued against Mr Riley’s Private Hire Driver’s Licence.

 

The Licensing Officer presented a report which detailed the circumstances which had led to Mr Riley being issued with four penalty points on his Private Hire Driver’s Licence. The Committee then heard evidence from the Licensing Enforcement Officer who had investigated the complaint and subsequently awarded the penalty points.

 

Mrs Proctor, the complainant, outlined the events that had occurred which had led to her making the complaint against Mr Riley.

 

(The Committee passed a resolution to exclude the press and public and all parties connected with the case, on the basis that, in making its decision, exempt information would be received in the form of legal advice on possible legal proceedings arising from the decision.)

 

It was proposed by Councillor  Budden and seconded by Councillor Gilbert :-

 

“That the Appeals Committee uphold the points awarded against Mr Riley’s Private Hire Driver’s Licence.”

 

On being put to the vote, all Members voted in favour of the proposal, whereupon the Chairman declared the proposition carried.

 

Resolved :

 

That the Appeals Committee uphold the points awarded against Mr Riley’s Private Hire Driver’s Licence.
