Minutes:

The minutes of the meeting held on 3rd June 2019 were signed by the Chair as a correct record.

There were no items of urgent business.

Declarations of Interest

To receive declarations by Councillors of interests in respect of items on this Agenda. 

Councillors are reminded that, in accordance with the Localism Act 2011, they are required to declare any disclosable pecuniary interests which have not already been declared in the Council’s Register of Interests. (It is a criminal offence not to declare a disclosable pecuniary interest either in the Register or at the meeting). 

Whilst not a legal requirement, in accordance with Council Procedure Rule 9 and in the interests of clarity and transparency, Councillors should declare any disclosable pecuniary interests which they have already declared in the Register, at this point in the meeting. 

In accordance with Part B Section 2 of the Code Of Conduct, Councillors are required to declare the existence and nature of any other interests as defined in paragraphs 8(1) or 9(2) of the Code of Conduct. 

 

Minutes:

Councillor Dave Brookes declared an interest in agenda item A5 18/01100/FUL B and Q Superstore, Aldcliffe Road, Lancaster. The reason being that he knows one of the public speakers personally and lives local to the site. Councillor Brookes stated that he would be viewing the application fairly and with an open mind.

 

Councillor Dave Brookes declared an interest in agenda item A6 19/00351/VCN G and L Car Services, Wheatfield Street, Lancaster. The reason being that he had reported unauthorised development on the site. Councillor Brookes also explained that the Applicant had circulated a covering letter which erroneously implied that as Ward Councillor he supported the scheme. Councillor Brookes stated that he would be viewing the application fairly and with an open mind.

 

Councillor Paul Anderton declared an interest in agenda item A8 18/01642/FUL Keer Park, Warton Road, Carnforth. The reason being that he knows the applicant. Councillor Anderton stated that he would leave the room during deliberation of this application.

Councillor Dave Brookes had previously declared an interest in the following two items.

A site visit was held in respect of this item on 28th January 2019 minute 112 (2018/2019 refers).

 

Under the scheme of public participation, Romy Clark spoke against the application and Malcolm Ball spoke in support. The Applicant Representative Adam Robson Property Director at Aldi then spoke in support of the application.

                                                                                        

It was proposed by Councillor Robert Redfern and seconded by Councillor Janice Hanson:

 

“That subject to no new and valid planning considerations being raised during the further period of public consultation ending on 5th July, which are not considered in the report or as part of the Committee’s consideration of the application at the Committee meeting, planning permission be granted subject to the conditions in the report, an amendment to the condition for a Service Delivery Management Plan to include details of waste management and extra conditions controlling the hours of construction and restricting permitted development rights”

 

Upon being put to the vote, 11 Councillors voted in favour of the proposal, with 3 abstentions, whereupon the Chair declared the proposal to be carried.

 

Resolved:

 

That subject to no new and valid planning considerations being raised during the further period of public consultation ending on 5th July, which are not considered in the report or as part of the Committee’s consideration of the application at the Committee meeting, planning permission be granted subject to the following conditions:

 

1.

Time limit (3 Years).

2.

Approved plans list.

Construction of site access and off-site highway works.

Submission of Tree Protection Plan and Arboricultural Method Statement.

Upon being put to the vote, 12 Councillors voted in favour of the proposition and 1 against, with 1 abstention, whereupon the Chair declared the proposal to be carried.

 

Resolved:
