The Chairman advised the committee that he wished to propose that consideration of items 5, 6 and 7 on the agenda be deferred until a further meeting of the committee in order that a further consultation with the trade could take place.
It was proposed by Councillor Wade and seconded by Councillor Johnson: -
“That consideration of items 5, 6 and 7 be deferred until further external consultation had taken place.”
Upon being put to the vote members voted unanimously in favour of the proposition, whereupon the Chairman declared the proposition to be carried.
Resolved:
That consideration of items 5, 6 and 7 be deferred until further external consultation had taken place.
Alan Humphreys left the meeting at this point and did not return. |

Exempt Items:- The Committee is recommended to pass the following recommendation in relation to the following items:
“That, in accordance with Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business, on the ground that they could involve the possible disclosure of exempt information, as defined in paragraph 1 of Schedule 12A of that Act.”
Members are reminded that, whilst the following items have been marked as exempt, it is for the Committee itself to decide whether or not to consider them in private or in public. In making the decision, Members should consider the relevant paragraph of Schedule 12A of the Local Government Act 1972, and should balance the interests of individuals, or the Committee itself, in having access to information. In considering their discretion, Members should also be mindful of the advice of Council Officers. Existing Hackney Carriage and Private Hire Driver's Licences - Shaun Robert Wilson Report of Licensing Manager Minutes: The Licensing Manager presented a report to enable members to consider what action, if any, to take in respect of Mr. Wilson’s hackney carriage and private hire driver’s licences. Details of the individual case are set out in exempt minute no. 51, in accordance with Section 100A of the Local Government Act 1972.
It was proposed by Councillor Johnson and seconded by Councillor Brown: -
“That Mr. Wilson’s hackney carriage and private hire driver’s licences be suspended from 3 January 2011 until he had passed the BTEC course “Transporting passengers by TAXI and Private Hire”.”
Upon being put to the vote members voted unanimously in favour of the proposition, whereupon the Chairman declared the proposition to be carried.
Resolved:
That Mr. Wilson’s hackney carriage and private hire driver’s licences be suspended from 3 January 2011 until he had passed the BTEC course “Transporting passengers by TAXI and Private Hire”. |

Existing Private Hire Operators Licence - Martin Payne Report of Licensing Manager Minutes: The Licensing Manager presented a report to enable members to consider what action, if any, to take in respect of Mr. Payne’s private hire operators licence. Details of the individual case are set out in exempt minute no. 52, in accordance with Section 100A of the Local Government Act 1972.
It was proposed by Councillor Brown and seconded by Councillor Johnson: -
“That no action be taken in respect of Mr. Payne’s private hire operator’s licence.”
Upon being put to the vote 6 members voted in favour of the proposition with 3 abstentions, whereupon the Chairman declared the proposition to be carried.
Resolved:
That no action be taken in respect of Mr. Payne’s private hire operator’s licence. |

Existing Private Hire Driver's Licence - Laurence William Dent Report of Licensing Manager Minutes: The Licensing Manager presented a report to enable members to consider what action, if any, to take in respect of Mr. Dent’s private hire driver’s licence. Details of the individual case are set out in exempt minute no. 53, in accordance with Section 100A of the Local Government Act 1972.
It was proposed by Councillor Johnson and seconded by Councillor Redfern: -
“That Mr. Dent’s private hire driver’s licence be suspended with immediate effect until he had passed the BTEC course “Transporting passengers by TAXI and Private Hire”.”
Upon being put to the vote 3 members voted in favour of the proposition and 4 members voted against, with 1 abstention, whereupon the Chairman declared the proposition to be lost.
It was proposed by Councillor Coates and seconded by Councillor Forrest: -
“That Mr. Dent’s private hire driver’s licence be suspended until he had passed the BTEC course “Transporting passengers by TAXI and Private Hire”.”
Upon being put to the vote members voted unanimously in favour of the proposition, whereupon the Chairman declared the proposition to be carried.

That Mr. Dent’s private hire driver’s licence be suspended until he had passed the BTEC course “Transporting passengers by TAXI and Private Hire”.

Prior to consideration of the following items the committee queried as to whether the remaining items could be deferred until the next meeting of the committee. It was advised that the next meeting of the committee was scheduled for 6 January 2011, members discussed the possibility of arranging an additional meeting in December in order to consider the outstanding items should they be deferred.
It was proposed by Councillor Day and seconded by Councillor Coates: -
“That the remaining items be deferred, and that an additional meeting of the committee be arranged for the earliest possible date in December in order that the outstanding items could be considered.”
Upon being put to the vote members voted unanimously in favour of the proposition, whereupon the Chairman declared the proposition to be lost.
